Home Safety Terms and Conditions
How the program works
Airbnb’s home safety program (“program”) connects Airbnb hosts with distributors of combination smoke and carbon monoxide alarms (“alarms”). Qualifying hosts are eligible to receive one alarm paid for by Airbnb (the “offer”). To qualify for the offer, hosts must be at least 18 years old and maintain at least one active Airbnb listing for accommodations. The program and offer are available for a limited time and may be discontinued at any time. Each host is limited to one alarm.
By applying to receive an alarm, you acknowledge and agree that Airbnb: (i) is not a manufacturer or distributor of any alarm(s); (ii) does not endorse or recommend any alarm(s); and (iii) assumes no responsibility as a manufacturer, endorser or distributor of third-party alarms or other products.
Airbnb will share your name, shipping or mailing address, and phone number with the manufacturer or distributor so that they can ship your order to you. Please allow 4-8 weeks for your order to be delivered. Delivery periods are estimated, not guaranteed, and actual delivery time may be shorter or longer. If the manufacturer or distributor is unable to fulfill your order, they (or another manufacturer or distributor) may provide an alarm with similar or equivalent functionality. The manufacturers and distributors we work with do not ship to certain locations—like Cuba—and if you reside in such a location you are not eligible for the program or offer.
Airbnb is not a party to your alarm order and you agree to have your order fulfilled and shipped directly to you by the manufacturer or distributor. You also agree that any disputes, returns, exchanges, repairs or other inquiries will be handled exclusively by the manufacturer or distributor, not by Airbnb.
By applying to receive an alarm, you agree to these program terms and conditions, including that: (i) we will share your name, shipping or mailing address, and phone number with the manufacturer and/or distributor as necessary to fulfill your order; (ii) you will use the alarm in your listing and in accordance with the manufacturer's instructions; and (iii) you remain entirely and solely responsible for your listing, including but not limited to its safety equipment and condition.
Disclaimer and release
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AIRBNB DISCLAIMS ALL LIABILITY AND WARRANTIES, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES: (A) AS TO THE DESIGN, QUALITY OR CONDITION OF THE GOODS; (B) AS TO THE MATERIAL, EQUIPMENT OR WORKMANSHIP IN THE GOODS; (C) OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; (D) AS TO THE SUITABILITY OF THE GOODS FOR BUYER'S PURPOSES OR THE IMPACT OF THE GOODS ON BUYER'S OPERATIONS; (E) AS TO THE SUITABILITY OR FITNESS OF THE MANUFACTURER OR DISTRIBUTOR; AND (F) WITH RESPECT TO ANY PATENT, COPYRIGHT, TRADEMARK, TRADE NAME, SERVICE MARK OR PROPRIETARY LAW OR RIGHT. THE ONLY WARRANTIES FOR THE ALARM ARE THOSE THAT MAY BE PROVIDED DIRECTLY BY THE MANUFACTURER OR DISTRIBUTOR OF THE ALARM.
By applying to receive an alarm, you release Airbnb, Inc., its affiliated entities, subsidiaries, their employees, officers, directors, employees and other agents from, from any and all losses, damages, debts, rights, claims, actions or other liabilities whatsoever, regardless of legal or other theory or description, including without limitation liability for death, injury or damage caused by or allegedly caused by participating in the program or any alarm received through the program, and to the fullest extent allowed by law waive any and all such claims and causes of action arising from or related to the alarm or this program.
Sales and other taxes
Airbnb will pay sales taxes on the alarms we pay for under this program, but you are responsible for any other applicable taxes including import duties and any other expenses applicable in your territory. You are responsible for complying with any regulations or limitations on courier, postal service providers, personal shipments and/or personal imports that may apply to you or your territory.
Any disputes related to this program will be resolved according to the dispute resolution process you have agreed to in our Terms of Service. The jurisdiction whose laws governs this program will be determined as set forth in the Airbnb Terms of Service. This program is void where prohibited. The manufacturer, distributor, and/or Airbnb shall have the right to refuse any alarm order in their sole discretion. This program is for a limited time only, and we may withdraw, change or suspend it (in whole or in part) at any time with or without notice to you. We can update these terms at any time without prior notice. If we modify these terms, we will post the modification and the modified terms will be effective upon posting. By participating in the program after we have posted updated terms, you agree to be bound by the updated terms. If the updated terms are not acceptable to you, your only recourse is to not participate in the program. We reserve the right to disqualify your order if you provide any inaccurate or false information. Nothing in this program amends or otherwise changes our agreement as stated in the Terms of Service.
