Reservation Insurance Privacy Notice for France

Please note that this Notice supplements our Privacy Policy and the supplemental Outside the United States subpage and applies to additional personal information processing which is carried out by us in order to provide Reservation Insurance to Airbnb Guests through the Airbnb platform.

1. Application

This Notice (“Notice”) provides additional information about the processing of personal information in connection with the insurance policies and insurance claims of individuals residing in the selected EU jurisdictions where Reservation Insurance is offered to Airbnb Guests through the Airbnb platform (“Reservation Insurance”).

2. Who controls my Personal Information

    2.1 Controller

    Where this Notice mentions “Airbnb,” “we,” “us,” or “our,” it refers to Airbnb Ireland UC and Airbnb Ireland Insurance Services Limited (“AIIS”), which are the Airbnb entities responsible for your information and data controllers if you reside in the EU for the Reservation Insurance. The two entities process your data independently - Airbnb Ireland UC is responsible for information related to the reservation of your accommodation for which the Reservation Insurance applies and AIIS is an independent controller of the information it processes to distribute the Reservation Insurance. The Reservation Insurance product is underwritten by Europ Assistance S.A., Irish Branch (“Europ Assistance”), who also acts as an independent data controller of your personal information. This Notice does not address how Europ Assistance or other third parties handle your personal information, see their privacy notice for more information.

      3. Personal Information We Collect

        If you choose to purchase Reservation Insurance, we may collect the below personal information:

        3.1 Personal Information You Choose to Give Us

          • Contact information, booking information. We collect your first name, last name, email address, date of birth, postal address and phone number. We also collect information about your trip to create the policy.

          3.2 Personal Information We Collect from Third Parties

          • If you submit a claim under a Reservation Insurance policy (“Policy”), through the insurance provider, Europ Assistance, Europ Assistance sends us your claim status (i.e. draft, submitted, reviewed, approved, closed, denied). Europ Assistance may share certain claim information with us including claim type, status, claim reason, claim amount submitted and paid and when your claim was processed.

          4. How We Use Personal Information We Collect

          We use the personal information we collect for the following purposes.

          4.1 Create and Manage Your Insurance Policy. 

          Such as to:

          • Collect the information required to create your Policy;
          • Make changes to your Policy if you decide to change your trip, or change your Policy;
          • Manage and resolve complaints regarding the insurance distribution services provided by AIIS;
          • Cancel your Policy if you decide to cancel your accommodation reservation or your Reservation Insurance.

            4.2 Improve and Develop Our Product. 

            Such as to determine the effectiveness of the program, improve the Reservation Insurance product by:

            • Performing analytics, debugging and conducting research;
            • Improving the user experience;
            • Providing customer service and training.

              4.3 Create and Maintain a Trusted and Safer Environment. 

              Such as to:

                • Detect and prevent fraud and security incidents.

                5. Sharing and Disclosure

                  We work with our partner Europ Assistance to provide you with the Reservation Insurance product. Europ Assistance is the insurance company underwriting the Reservation Insurance for Airbnb Guests and is licensed to sell insurance products in the EU. We share with them personal information we collect as necessary to enable them to price and provide your Policy. This includes information about your Policy, your trip, and personal information including your name, contact details and date of birth, and any other information described in Section 3 of this Notice that is required to meet their obligations in connection with the Reservation Insurance product, including any legal and regulatory obligations, in order to complete the purchase. We may also share your personal information with other third parties as set out at Section 4 of our Privacy Policy.

                    6. Legal Bases for Processing Personal Information

                    We process your personal information as necessary to conclude and perform our contract with you to deliver your Reservation Insurance.

                    We process this personal information for these purposes given our legitimate interest in improving Airbnb and our users’ experience with it, and to comply with applicable laws, for the protection of your or another person's vital interests, and for reasons of public interest.

                    Conduct audits, verify that our internal processes function as intended and are compliant with legal, regulatory or contractual requirements; monitor for and prevent fraud; and security purposes, including system security and on-site security of our premises.

                    7. Your Rights

                    You benefit from rights pursuant to applicable law. While some of these rights apply generally, certain rights apply only in certain limited cases. We may ask you to verify your identity and request before taking further action on your request.                     You have the right to lodge complaints about our data processing activities by filing a complaint with our Data Protection Officer who can be reached by the “Contact Us” section above or with your local supervisory authority or our lead supervisory authority, the Irish Data Protection Commission.                     8. Retention

                      We retain information related to the Reservation Insurance program for a period of up to four years to fulfil our contractual obligations to you and improve your experience on the Airbnb platform. Where a legal obligation arises or retention is advisable in light of our legal position, in some circumstances, we will retain certain personal information for a longer period, even after your account has been deleted, for example:

                      • To cooperate with law enforcement or public, regulatory and government authorities: If we receive a preservation order or search warrant, related to your account, we will preserve personal information subject to such order or warrant.
                      • To comply with insurance regulations and legal provisions on tax and accounting: We may retain your personal information as required by insurance and tax law and to comply with bookkeeping requirements.
                      • To pursue or defend a legal action: We may retain relevant personal information in the event of a legal claim or complaint, including regulatory investigations or legal proceedings about a claim related to your personal information, or if we reasonably believe there is a prospect of litigation (whether in respect of our relationship with you or otherwise) for a period of time after the dispute has been settled or decided by a court or tribunal from which there is no further right of appeal.

                      9. Operating Globally and International Transfers

                        As explained above in Section 5 of this Notice, in order to provide Reservation Insurance, we share the personal information we collect with Europ Assistance. We have established the necessary means to ensure an adequate level of data protection for any personal information transferred outside the EEA. For any personal information transferred from the EEA to the United Kingdom a European Commission adequacy decision applies. We have also put in place standard contractual clauses within Airbnb and with the relevant third parties to protect personal information and comply with data protection law.
