Airbnb's community and vision for travel have grown significantly, so we updated our Terms of Service, Payments Terms of Service, and Privacy Policy (collectively, “Terms”).

The Terms are effective immediately for first time users on or after June 19, 2017. Capitalised terms not defined on this page have the same meanings given to them in the Terms. Existing users will be asked to agree to the updated Terms on September 01, 2017. Please take the time to read them carefully.

Notable changes to the Terms include:

Updates to the Terms of Service

  • We rewrote and restructured the Terms of Service to make them shorter, more concise, and easier to read (e.g. by adding a table of contents to make individual sections of the Terms directly accessible).
  • We updated the Terms of Service to reflect new types of services available on Airbnb (such as Experiences and Events).
  • We added a section on Co-Hosting.
  • We limited the license granted to Airbnb on feedback received from users.
  • We updated and simplified the Arbitration clause.
  • In line with the changes to the Terms of Service, we streamlined the Guest Refund Policy and Host Guarantee Terms to also make these policies shorter and easier to read. Specifically, for the Host Guarantee Terms:
    • We updated and simplified the process for notifying Guests and Airbnb of damages that may be covered under the Host Guarantee.
    • We clarified the exclusion of losses relating to electronic data.
    • We updated and simplified the Arbitration clause.

Updates to Payments Terms of Service

  • We rewrote and restructured the Payments Terms of Service to make them shorter, more concise, and easier to read.
  • We clarified the requirements, procedures, and verification process for adding and using Payment Methods and Payout Methods.
  • We clarified how Airbnb Payments collects funds from Guests and Hosts, how and when Hosts receive Payouts, and when funds would be considered past due.
  • We clarified when and how we apply currency conversion to payments and payouts.
  • We limited the license granted to Airbnb Payments on feedback received from users.
  • We updated and simplified the Arbitration clause.
  • We clarified the applicable law and jurisdiction for users contracting with Airbnb Payments, Inc., Airbnb Payments UK Ltd., and Airbnb Payments India Pvt. Ltd.

Updates to the Privacy Policy

  • We rewrote and restructured much of the Privacy Policy to make it shorter, more concise, and easier to read.
  • We updated the Privacy Policy to better reflect new services available on Airbnb.
  • We clarified how Airbnb and third parties use cookies and similar technologies on Airbnb (see the updated Cookie Policy).
  • We’ve updated the terms around sharing of information between Hosts and Guests.
  • We clarified the terms around when Airbnb may be required disclose some of your information to comply with the law.
  • We updated the terms around how we share your information within our corporate family of companies.
  • We explain that Airbnb will comply with the Swiss-EU Privacy Shield relating to personal data of users from Switzerland.

Here are a few common questions that you may have about this process.
I first registered for my Airbnb account before June 19, 2017. What will happen on September 01, 2017?

Starting from September 01, 2017, users who registered for their Airbnb account before June 19, 2017 (“Existing Users”) will be asked to review and agree to the updated Terms of Service, Payments Terms of Service, and Privacy Policy. You will have to agree before you can continue to access your account. If you disagree with the new Terms, we’ll give you information on your options for completing existing reservations and cancelling your account. If you have any questions or encounter any difficulties during this process, please e-mail terms@airbnb.com for assistance. Existing Users will not be able to agree earlier than September 01, 2017.

I first registered for my Airbnb account on or after June 19, 2017. Which Terms apply to me?

If you register for your Airbnb account on or after June 19, 2017, you will, upon registration, agree to the new Terms of Service, Payments Terms of Service, and Privacy Policy. These new Terms will apply to you immediately.

Do these new Terms apply to my upcoming confirmed bookings?

The updated Terms of Service and Payments Terms of Service will apply to all activities (including existing, confirmed bookings) on the Airbnb platform from the time you agree to them. If you are an Existing User and you do not agree to the new Terms, the previous version of the Terms of Service, Payments Terms of Service, and Privacy Policy will continue to apply to bookings you confirmed before September 01, 2017 10:00 am UTC. Once you agree to the new Terms, the Privacy Policy will apply to information obtained by us since you joined the site.

The old and new versions of the Terms can be found at the Terms of Service, Payments Terms of Service, Privacy Policy tabs. Both old and new versions will continue to be available through October 01, 2017, after which the tabs will be updated to show only the latest versions.
